Welcome to Otherworldly Travel LLC (“Company,” “we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your use of our website, services, and any bookings made through us. By accessing our website or using our services, you agree to comply with and be bound by these Terms. If you do not agree with these Terms, please do not use our services.

1. Acceptance of Terms

By using our services, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you are using our services on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

2. Services Provided

Otherworldly Travel LLC provides travel-related services, including but not limited to travel planning, booking, and consultation. All services are subject to availability and may change without notice. We reserve the right to refuse service to anyone for any reason at any time.

3. Booking and Payment

When you book a service with us, you agree to provide accurate and complete information. All bookings require a non-refundable deposit at the time of confirmation unless otherwise stated. Balance payments are due 90 days prior to the booked travel start date. Prices are subject to change until the booking is confirmed. We reserve the right to cancel any booking if payment is not received in full or if there is a risk of fraudulent activity.

4. Cancellation and Refund Policy

Cancellations and refunds are subject to the specific terms provided at the time of booking. Some bookings may be non-refundable. If a cancellation is permitted, you may be entitled to a partial refund according to our policies and those of our partners or suppliers. Administrative fees may apply.

We understand that plans can change, and you may need to cancel your travel arrangements before your trip begins. We will make every reasonable effort to work with our suppliers to secure refunds for your payments. However, we cannot guarantee the success of these efforts. Suppliers may choose to issue travel vouchers or credits instead of refunds. We are not responsible for a supplier’s failure, inability, or refusal to provide a refund. Additionally, any remaining travelers may experience a change in pricing due to the cancellation.

Furthermore, you will be required to compensate Otherworldly Travel LLC for the economic loss and opportunity cost associated with the time and effort spent organizing your travel plans (the "Termination Fee"). Otherworldly Travel LLC will be entitled to the following amounts:

  • More than 91 calendar days before departure: Otherworldly Travel LLC will retain 25% of the total trip cost.

  • Between 90 and 31 calendar days (exclusive) before departure: Otherworldly Travel LLC will retain 50% of the total trip cost.

  • Within 30 calendar days (inclusive) before departure: Otherworldly Travel LLC will retain 100% of the total trip cost.

5. Force Majeure

Otherworldly Travel LLC shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to acts of God, natural disasters, pandemic or epidemic, fire, flood, earthquake, storm, war, armed conflict, acts of terrorism, civil unrest, riots, government action or restriction, travel advisories issued by the US Department of State or equivalent authority, strikes, or any other event that makes performance impossible, illegal, or inadvisable ("Force Majeure Event").

In the event of a Force Majeure Event, Otherworldly Travel LLC will notify you as soon as reasonably practicable and will use reasonable efforts to mitigate the impact, including working with suppliers to secure credits, rebooking options, or partial refunds where available. We do not guarantee that such efforts will result in a full or partial refund, as supplier policies vary and are outside our control.

Where a Force Majeure Event prevents travel from proceeding, Otherworldly Travel LLC's cancellation and termination fees as described in Section 4 will be waived or reduced at our discretion, depending on the circumstances and the costs already incurred on your behalf. Any supplier costs already paid and non-recoverable will remain your responsibility.

For the avoidance of doubt, the following do not constitute Force Majeure Events: personal circumstances, change of mind, illness not rising to the level of a declared public health emergency, or financial hardship.

6. Travel Insurance

We strongly recommend that you purchase travel insurance to protect against unforeseen events, such as trip cancellations, delays, or emergencies. Otherworldly Travel LLC does not provide travel insurance but can assist you in obtaining it through third-party providers.

7. User Responsibilities

You are responsible for ensuring that you meet all requirements for travel, including but not limited to, possessing valid identification, visas, and necessary immunizations. Otherworldly Travel LLC is not responsible for any losses or delays resulting from your failure to comply with such requirements.

8. Limitation of Liability

To the fullest extent permitted by law, Otherworldly Travel LLC will not be liable for any direct, indirect, incidental, or consequential damages arising out of or in connection with your use of our services. This includes, but is not limited to, damages for personal injury, lost profits, or travel disruptions.

9. Indemnification

You agree to indemnify and hold harmless Otherworldly Travel LLC, its affiliates, officers, employees, and agents from and against any and all claims, liabilities, damages, losses, or expenses arising out of or in connection with your use of our services or violation of these Terms.

10. Third-Party Services

Our services may include links to third-party websites or services that are not owned or controlled by Otherworldly Travel LLC. We do not endorse or assume any responsibility for any third-party sites, information, materials, products, or services. You access third-party websites at your own risk.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of laws principles. Any disputes arising out of or related to these Terms or our services will be resolved exclusively in the state or federal courts located in the United States of America, Delaware.

12. Amendments to Terms

We may update or modify these Terms at any time without prior notice. Any changes will be effective immediately upon posting. Your continued use of our services following any changes constitutes your acceptance of the new Terms.
